Website Terms of Use

The term “Wine Please” or “us” or “we” refers to the owner of the website “Wine Please Pty Ltd” ACN 162 485 092 as trustee for “The Wine Please Trust”. The term “you” refers to the user of the website. By continuing to view and use this website, you agree to the terms and conditions of use, along with the privacy policy which is used to govern the relationship between you and this website. Placement of an order on this website or any other use of content on this website, is deemed as acceptance of these Terms and Conditions. If you do not agree with these Terms and Conditions, do not use or access any material or content on this site.

The content of this website is for your general information and use only. It is subject to change without notice.

Except as required by the Australian Consumer Law:

(i) neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, completeness or suitability of the information on this website;

(ii) any opinions, advice or statements made available on the Wine Please website are those of the respective authors, suppliers or distributors;

(iii) we neither endorse nor are responsible for the accuracy or reliability of these opinions, advices or statements;

(iv) you acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or error. Your use of the information on this website is at your own risk;

(v) the contents of the site do not constitute advice and should not be relied upon in making any decision; and

(vi) it is your responsibility to ensure that any products or information sourced from this website, meet your specific needs.

Sale of Alcohol

Under Packaged Liquor & Sales Licence No. 57704273 and the Liquor Licensing Act 1997 SA, it is an offence to supply alcohol to a person under the age of 18 years. By using this website, you confirm that you are over the age of 18 and that the person receiving any shipment of alcohol is also over the age of 18. It is a condition of purchase that you are over 18 years of age, and proof of your age may be required on delivery of goods.

 

Payment

Wine Please accepts all major credit cards including Visa, Mastercard and American Express. Use of American Express will incur a surcharge applied to the total order. We do not accept Diners Club cards.

We also accept direct debit and are happy to provide banking details on request if that is your preferred payment method.

 

Order - Modify/Cancel

Orders cannot be changed or cancelled after they are placed unless we in our absolute discretion agree to do so.  If you wish to amend or cancel your order before shipping by us,  please contact our customer service staff at orders@wineplease.com.au as soon as possible.  We will consider your request as long as it is received by us before shipping, however no guarantee can be made to modify or cancel an order after it is placed.

 

Product Availability / Pricing

All pricing listed on the Wine Please site are in $AUD (Australian Dollars) and fully inclusive of GST. Products are available for delivery only within Australia (subject to restrictions outlined in Delivery section including restrictions to delivery to Dry Zones). Wine Please reserves the right to change pricing without notice at anytime before accepting any order.

All products are ordered as current vintage, we reserve the right to supply the vintage we have available at the time of closure of your registry.

 

Delivery

Deliveries are only available within Australia (excl NT and some regional areas in other States).  Wine Please uses both Fastway and Australia Post as our logistics providers, to ensure that the products you have purchased arrive in good condition and a timely manner. Expected delivery times are 5-7 business days for most metro areas in Australia (we do not deliver to NT).  For regional areas, delivery times may be slightly longer. If you have not received your order within 5-7 business days of us providing you with the tracking details, please contact us at orders@wineplease.com.au so we can follow up any issues.

Deliveries can only be made to physical addresses and not to a PO Box. As all deliveries are made during business hours, it is preferable to deliver to a business address or address where someone is present during business hours. As a condition of our Liquor Licence, we can only accept receipt of delivery by someone over the age of 18 years at the receiving address.

 

Returns & Refunds

Our Returns Policy includes the rights you have under the Australian Consumer Law and provides you with additional benefits in addition to those rights.

In the event that your purchase contains any faulty, damaged or wrongly described products, then upon receipt of the returned product, we will provide a refund to you or exchange the product.  As wine is a living organism, there is the potential that it may have become faulty at some point between bottling and being delivered to you. If you believe your wine has a fault, please contact us at hello@wineplease.com.au in order for us to make arrangements. We often suggest to open an additional bottle to check if the whole order is impacted or not. Please ensure that you return the faulty bottle so we can pass this onto our suppliers for assessment. Please allow 2-3 business days after returning the faulty products for the refund to be processed. Wine Please will cover the costs of the return freight in the case that a wine is confirmed to be faulty.

Any links to third party sites contained on this website, are provided solely for your convenience. Access to these sites and the products and services made available at those sites, is solely at your own risk. These links do not indicate expressly, or impliedly, any endorsement of those products and services by Wine Please.

 

Promotional Voucher Codes

Promotional voucher codes cannot be exchanged for cash, used in conjunction with one another, re-used on another transaction, or partially used across multiple orders.

 

Registry

Managing your List

Once you have registered your details and created a registry, you are able to edit your registry list up till the point it is either closed by you or by the Wine Please administrator. Only products that have not been purchased can be edited in your registry. If a listed product has already been purchased, you are only able to add quantities or remove any remaining quantities.

 

Wine Please reserves the right to remove your registry list from the site if there has been more than 6 months of inactivity. We will contact you via email prior to removing any registry created. Additionally we reserve the right to decline to manage any list, and in no event will we be liable to you in excess of any amount payable by you for any goods purchased through our site.

 

Wine Please reserves the right to change product prices at any time. New pricing will be reflected automatically in your list of registry items, however will only be applied to remaining quantities of products not already purchased.

 

Closing Your List

Your gift registry will be automatically closed 1 week after your nominated event date, unless you request it to be closed earlier.

There is a possibility that products you have listed on your registry, will no longer be available once the registry is closed off - particularly when the registry is open for several months. In this instance you will be provided with store credit that you can put towards purchasing remaining registry items, or we can suggest suitable replacement products. Availability refers to both the product and vintage.

 

Registry Delivery

Delivery will be made approximately 3-4 weeks after the date that the registry is closed, or at a convenient time arranged after this date. Delivery will only be to one single address. Delivery is included for most Australian metro areas (excl Northern Territory). A nominal guest charge is made per purchase to cover delivery and processing of purchased registry products. For some larger items, an additional delivery fee may be payable, and you will be advised by Wine Please the approx costs when you add such an item to your list – e.g. Wine Fridge. For delivery addresses outside of metro areas, a consultant from Wine Please will contact you to indicate approximate delivery costs when your registry is created. Alternatively, you are able to arrange for your own freight provider to pick up the gifts from our warehouse at your own cost.

 

Gift Storage

In the event that you do not want to receive delivery for a period of time after the registry is closed off, Wine Please is able to store your products in our warehouse for up to a period of 3 months. An administration and storage fee of $50/mth is payable.

 

Cancelled or Postponed Occasions

In the event of an occasion being postponed or cancelled for any reason, it will be your responsibility to contact the Gift Registry at Wine Please so that the necessary arrangements can take place.

 

Your guests will be given the following options for a cancelled occasion:

  • A refund on the purchase made – less the administration charge of $12.95

        OR

  • Delivery to an address nominated by the guest, provided the gift delivery fee has been paid (gifts will not be delivered to you unless instructed to do so by guests).

        OR

  • Store credit for the product value only.

 

Wine Club - Private Wine Buying (Offline please email us for details)

Payment / Delivery Cycle

The Wine Please Club has one delivery window per month, with dispatch occurring on the 15th. In order to be included in this month’s delivery window, we need to have received your order/payment prior to the 5th of that month. If you place your order for a wine subscription after the 5th of the month, you will fall into the following month’s delivery window. In this case you will not be charged till the 5th of the following month, and your wine will be dispatched on the 15th of that same month. For customers you are already subscribed, your payment will come out automatically on the 5th of the month that you are due for delivery – depending on whether you have a monthly or quarterly subscription.

In the event that you wish to cancel or amend your subscription, you are able to do this at anytime by emailing orders@wineplease.com.au with your request. Once again this request needs to occur prior to the 5th of the month in order for the amendment or cancellation to be made.

If you are a current subscriber and your regular payment is not approved by your card issuer, your subscription will be placed on hold until payment is received. Wine Please will get in contact with you if this situation occurs, so that your delivery is unaffected if possible.

 

Wine Club Refunds

Our refund policy applies to our wine club products. So if you believe that any of the wine you have received is faulty, please notify us immediately so that we can either provide a replacement or substitution for the faulty wines. In the event that you are not happy with the quality or style of wine provided, once again please contact us at orders@wineplease.com.au so that we can provide an option that is better suited to your preferences.

Wine Please regards customer privacy as an important part of our relationship with our customers. The following privacy policy applies to all Wine Please users, and conforms to Internet privacy standards.

Collection of Information

In order to use the Wine Please website, we may require information from you in order to provide the best service possible. All correspondence may also be collected and stored, particularly in regard to sales, support and accounts, including Email. Any information collected by Wine Please is collected via correspondence from you or your company. This may be via the telephone, Email, mail, fax or directly through our website.

 

Use of Collection Information

Any details collected from Wine Please customers is required in order to provide you with our products and/or services, and a high level of customer service. Correspondence is recorded in order to provide service references, and to assist in our staff development. 

 

Storage of Collected Information

The security of your personal information is important to us. When you enter sensitive information (such as credit card numbers) on our website, we encrypt that information using secure socket layer technology (SSL). When Credit Card details are collected, we simply pass them on in order to be processed as required. We never permanently store complete Credit Card details. We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it. Access to Collected Information

If your personally identifiable information changes, or if you no longer desire our service, you may correct, update, delete or deactivate it by emailing us at hello@wineplease.com.au

 

Orders

If you purchase a product or service from us, we may request certain personally identifiable information from you. You may be required to provide contact information (such as name, Email, and postal address) and financial information (such as credit card number, expiration date). We use this information for billing purposes and to fill your orders. If we have trouble processing an order, we will use this information to contact you.

 

Communications

Wine Please uses personally identifiable information for essential communications, such as Emails, accounts information, and critical service details. We may also use this information for other purposes, including some promotional Emails. If at any time a customer wishes not to receive such correspondence, they can request to be removed from any mailing lists by emailing us at hello@wineplease.com.au Acceptance of our Terms & Conditions automatically adds your details to our mailing list. Please unsubscribe at anytime if you do not wish to receive further correspondence.

You will be notified when your personal information is collected by any third party that is not our agent/service provider, so you can make an informed choice as to whether or not to share your information with that party.

 

Third Parties

Wine Please may at its discretion use other third parties to provide essential services on our site or for our business processes. We may share your details as necessary for the third party to provide that service. These third parties are prohibited from using your personally identifiable information for any other purpose. Wine Please does not share any information with third parties for any unknown or unrelated uses.

We reserve the right to disclose your personally identifiable information as required by law and when we believe that disclosure is necessary to protect our rights and/or comply with a judicial proceeding, court order, or legal process served on our Website.

Wine Please Security Policy

Wine Please uses the eWAY Payment Gateway for its online credit card transactions. All online credit card transactions performed on this site using the eWAY gateway are secured payments.

  • Payments are fully automated with an immediate response.
  • Your complete credit card number cannot be viewed by Wine Please or any outside party.
  • All transactions are performed under 128 Bit SSL Certificate.
  • All transaction data is encrypted for storage within eWAY’s bank-grade data centre, further protecting your credit card data.
  • eWAY is an authorised third party processor for all the major Australian banks.
  • eWAY at no time touches your funds; all monies are directly transferred from your credit card to the merchant account held by Wine Please.
